1. About us

This website is operated by Cyberfox Services LLC, 1209 Mountain Road PL NE, Ste R, Albuquerque, NM 87110, USA ("we", "us").

2. Our services

We provide call forwarding and call center software (Dialrix), Google Ads and Meta Ads management, advertising account support, website design and SEO. The scope, fees and timelines for any engagement are set out in a separate written proposal or agreement, which prevails over these terms if they conflict.

3. No guarantee of results

Advertising and search performance depend on many factors outside our control, including platform policies, competition, budgets and market conditions. We do not guarantee specific rankings, traffic, leads, sales or return on ad spend. We also cannot guarantee the outcome of any ad account review, verification or appeal, as decisions are made by the relevant platform.

4. Client responsibilities

Clients must provide accurate information and timely access, hold the rights to content they supply, and comply with applicable laws and the policies of advertising platforms. Advertising spend is paid by the client directly to the platform unless agreed otherwise in writing.

5. Fees and payment

Fees, billing cycles and payment terms are set out in the applicable proposal or invoice. Late payment may result in suspension of services.

6. Software use (Dialrix)

Access to Dialrix is licensed, not sold, and is for your internal business use. You are responsible for the activity of your users, for lawful use of call recording and call forwarding features, and for any consents or notices required by law. You must not misuse, resell, reverse engineer or disrupt the service.

7. Intellectual property

The website, software, text, design and branding belong to us or our licensors. Deliverables created for a client are transferred or licensed as set out in the relevant agreement, once paid in full.

8. Confidentiality

Each party will keep the other's non-public business information confidential and use it only for the services.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, revenue or data. Our total liability for any claim is limited to the fees paid to us for the services giving rise to the claim in the three months before the claim. Nothing excludes liability that cannot be excluded by law.

10. Website content

Website content is provided for general information and may change without notice. It is not professional advice.

11. Termination

Either party may end an engagement as set out in the applicable agreement. We may suspend access to services for breach of these terms or non-payment.

12. Governing law

These terms are governed by the laws of the State of New Mexico, USA, and the courts of the State of New Mexico, USA have jurisdiction, unless your written agreement with us says otherwise.
